By accessing, browsing, using, or interacting with the Site in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and the Privacy Policy. If you do not agree, do not access or use the Site.
Who We Are
"Nonsurgical Orthopedics," "we," "us," and "our" refer to the physician-owned medical practice associated with Key West Concierge Orthopedics LLC, located at Key West, Florida, with email contact through Contact Here and telephone contact at the practice telephone number published on the Site.
Intended Audience; Eligibility; Geographic Scope
The Site is intended for adults seeking general educational information about non-surgical orthopedic care, sports medicine, image-guided procedures, physical rehabilitation, bracing and support, PRP injections, stem cell therapy, BMAC joint injections, ReNu joint injections, AmnioFix for joints, Clarix Flo injections, adipose allograft injections, exosome therapy, cortisone injections, viscosupplementation, nerve blocks, and trigger point injections. The Site is directed to users located in the United States. We make no representation that the Site or its content is appropriate, lawful, or available in any other jurisdiction. You are solely responsible for compliance with the laws of the jurisdiction from which you access the Site.
You may not use the Site if you are barred from doing so under applicable law or if you are accessing the Site for any prohibited, competitive, automated, unlawful, or exploitative purpose.

Emergencies
The Site is not intended for use in a medical emergency. This includes a psychiatric emergency, an urgent neurologic event, a severe infection, chest pain, shortness of breath, severe bleeding, signs of stroke, severe trauma, loss of consciousness, suicidal thinking, or any other emergent or potentially life-threatening condition. All medical care involves uncertainty. Any treatment described on the Site may involve risks, adverse events, discomfort, lack of response, temporary benefit only, need for additional treatment, worsening of symptoms, or unforeseen complications. Any testimonial, endorsement, before-and-after description, anecdote, review, or case example reflects only an individual experience and is not a promise, warranty, or predictor of any other person's results.
Regenerative Medicine; Off-Label; Investigational; Regulatory Notice
Certain treatments referenced on the Site, including but not limited to stem cell therapy, BMAC injections, adipose allograft injections, exosome therapy, amniotic or placental tissue products, Clarix Flo, ReNu, and similar regenerative, biologic, or tissue-based interventions, may be used off-label, may be investigational, and may not be approved by the U.S. Food and Drug Administration for specific orthopedic indications. "Off-label" means a legally marketed product is used in a manner not specifically approved in FDA labeling. "Investigational" means a therapy, indication, protocol, or asserted use may still be under clinical study, limited evidence development, or regulatory review. FDA states that there are currently no FDA-approved exosome products and that regenerative medicine therapies have not been approved for orthopedic conditions such as osteoarthritis, tendonitis, disc disease, tennis elbow, back pain, hip pain, knee pain, neck pain, or shoulder pain. Florida's 2025 stem-cell statutes require a specific advertisement notice and signed consent for covered stem cell therapy.
To the extent the Site advertises stem cell therapy governed by Florida law, the following statutory notice is incorporated here and should be read in conjunction with all service descriptions:
THIS NOTICE MUST BE PROVIDED TO YOU UNDER FLORIDA LAW. This physician performs one or more stem cell therapies that have not yet been approved by the United States Food and Drug Administration. You are encouraged to consult with your primary care provider before undergoing any stem cell therapy.
Nothing on the Site is intended to state or imply that any regenerative product or procedure is FDA-approved for a specific orthopedic use unless we expressly say so in writing. Nothing on the Site replaces the separate informed-consent process required before any actual treatment. Under Florida law, including but not limited to F.S. 766.103 (informed consent) and F.S. 459.0127 (osteopathic stem cell therapy consent and advertising), a patient must receive individualized disclosure of risks, benefits, alternatives, and nature of proposed treatment before consenting to a procedure. Website content does not satisfy, substitute for, or modify any such informed-consent requirement.
Product Classification; Intended Use; Tissue-Based Product Framework
The FDA determines how a medical product is classified and regulated based in part on the product's "intended use," which may be established through labeling, advertising, and other expressions of objective intent (see 21 CFR 201.128). You may not copy, reproduce, republish, display, transmit, scrape, frame, mirror, excerpt, adapt, modify, translate, reverse engineer, sell, sublicense, commercially exploit, or create derivative works from any Site content without our prior written consent. Any permitted citation or quotation must be minimal, accurate, non-misleading, and accompanied by clear attribution.

Prohibited Conduct

User Communications; Submissions; No Confidentiality for Unsolicited Content
Except to the extent prohibited by applicable law or superseded by a separately established patient relationship and applicable privacy law, any non-clinical communication, idea, suggestion, feedback, comment, technical report, or other unsolicited submission you send to us through the Site is non-confidential and may be used by us without restriction, attribution, or compensation. Do not send proprietary business ideas, confidential materials, trade secrets, or protected information you do not want disclosed or used.
If you submit any content, you represent that you own it or have all necessary rights to submit it, that it does not violate any law or third-party right, and that it does not contain malware or harmful code. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Key West Concierge Orthopedics LLC, its owners, physicians, contractors, employees, staff, affiliates, licensors, representatives, and agents shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages arising out of or relating to the Site, your use of or inability to use the Site, Site content, user submissions, third-party content, security incidents, unauthorized access, data alteration, service interruption, loss of goodwill, lost profits, lost opportunity, personal injury, emotional distress, or any decision made in reliance on Site content, even if advised of the possibility of such damages.
If, notwithstanding the foregoing, liability is imposed, the total cumulative liability of all released parties for any and all claims arising out of or relating to the Site shall not exceed the lesser of one hundred dollars ($100.00) or the amount, if any, you paid directly to us solely for access to the Site.
Nothing in these Terms is intended to waive liability that cannot lawfully be disclaimed under applicable law.
Indemnification
You agree to indemnify, defend, and hold harmless Key West Concierge Orthopedics LLC, its owners, physicians, contractors, employees, staff, affiliates, licensors, representatives, and agents from and against any and all claims, demands, actions, liabilities, losses, damages, judgments, settlements, penalties, fines, costs, and expenses, including reasonable attorneys' fees and costs, arising out of or related to: your use of the Site; your breach of these Terms; your violation of applicable law; your infringement or misappropriation of any intellectual property or privacy right; your submission of any content or information through the Site; or your use of the Site for scraping, AI training, competitive intelligence, or other prohibited conduct.
Equitable Relief; Monitoring; Preservation of Evidence; Remedies
You acknowledge that actual damages may be inadequate for certain breaches of these Terms, particularly breaches involving intellectual property, data extraction, AI training, circumvention of technical controls, confidential information, impersonation, or security abuse. We may seek temporary, preliminary, and permanent injunctive relief, specific performance, equitable relief, impoundment, preservation orders, expedited discovery, and any other remedy available at law or in equity without posting bond where permitted.
We may monitor Site access, traffic, submissions, logs, request patterns, and technical events for security, integrity, compliance, and evidentiary purposes. We may preserve and disclose information when we believe in good faith that doing so is necessary to protect the practice, patients, visitors, systems, property, public safety, or legal rights, or to comply with law, subpoena, court order, or law-enforcement request.
Any person or entity that violates these Terms by infringing Site content, scraping data, using the Site for AI training, bypassing security controls, or otherwise misappropriating Site assets may be subject to claims for actual damages, statutory damages, disgorgement, restitution, enhanced damages, punitive or exemplary damages where authorized by law, injunctive relief, attorneys' fees, expert fees, costs, and all other available remedies.
Pre-Suit Notice; Class Action Waiver; Jury Trial Waiver; Time Limit
Before filing any claim arising out of or relating to the Site, you agree to give us written notice describing the claim in reasonable detail and to allow at least thirty (30) days for investigation and an opportunity to resolve the matter informally. This paragraph does not limit our right to seek immediate injunctive or other equitable relief.
To the maximum extent permitted by law, you and we agree that any claim relating to the Site shall be brought only in an individual capacity and not as a plaintiff, class representative, class member, private attorney general, or participant in any representative, consolidated, or collective action.
To the maximum extent permitted by law, you and we knowingly, voluntarily, and intentionally waive any right to trial by jury in any action arising out of or relating to the Site or these Terms.
Any claim by you arising out of or relating to the Site must be commenced within one (1) year after the claim arises, or it is forever barred, to the extent permitted by law.
Governing Law; Exclusive Venue
These Terms and any dispute arising out of or relating to the Site or these Terms shall be governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any action shall be brought exclusively in the state courts located in Monroe County, Florida, or, if federal jurisdiction exists, in the appropriate federal court serving Monroe County, Florida. You irrevocably consent to personal jurisdiction and venue in those courts and waive any objection based on forum non conveniens, improper venue, or inconvenient forum.
Privacy Policy
Your use of the Site is also governed by the Privacy Policy, which is incorporated into these Terms by reference. In the event of a conflict between the Privacy Policy and these Terms regarding Site use restrictions, intellectual property, remedies, or dispute provisions, these Terms control to the fullest extent permitted by law.
Changes to the Site and These Terms
We may modify, suspend, withdraw, restrict, or discontinue any part of the Site at any time without notice. We may revise these Terms at any time by posting an updated version on the Site. The updated Terms become effective immediately upon posting unless a later effective date is stated. Your continued use of the Site after updated Terms are posted constitutes binding acceptance of the revised Terms.
Severability; No Waiver; Entire Agreement; Assignment
If any provision of these Terms is held unenforceable, that provision shall be interpreted as narrowly as necessary to make it enforceable, or, if necessary, severed, and the remaining provisions shall remain in full force. No waiver is effective unless in writing and signed by an authorized representative. A failure to enforce any provision is not a waiver. These Terms, together with the Privacy Policy, Medical Review Policy, and Accessibility Policy, constitute the entire agreement concerning Site use and supersede prior or contemporaneous understandings relating to the Site. The limitation of liability, indemnification, disclaimer of warranties, class action waiver, jury trial waiver, governing law, and exclusive venue provisions of these Terms apply to all disputes arising under or relating to any of those policies. You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, sale, reorganization, asset transfer, or change in control.
